
Wind up a charity |
When you wind up the charity, you must:
- complete a statutory declaration, signed by the organisation’s secretary, stating that the organisation has ceased to exist
- attach a copy of the special resolution resolving to cancel the authority to fundraise, signed by two office bearers
- attach the original certificate of registration or sanction. If you have lost or destroyed the original certificate, attach a statutory declaration signed by the secretary
- include a final audited statement in relation to the assets and liabilities of the organisation (see requirements and reporting)
- lodge the paperwork with us.
If the organisation is also incorporated under the Associations Incorporation Act 1981, follow the requirements for winding up an association.
To still operate as an incorporated association
If your organisation will no longer fundraise for charity but will operate as an incorporated association, lodge these documents to cancel its registration or sanction:
- a copy of the resolution stating that the association will no longer conduct appeals for support for the charitable purposes stated in its constitution. Two management committee members must certify this document as being true and correct
- a statutory declaration, signed by the secretary, stating that the association will no longer conduct appeals for support for the charitable or community purposes stated in its constitution
- a statement advising how the association will continue to function without conducting fundraising activities for charitable purposes
- the original certificate of registration or sanction. If you have lost or destroyed the original, also lodge a statutory declaration signed by the secretary.
