
Who needs a licence? |
For real estate agents
If you do any of the following activities for financial reward, you must get a real estate agent licence:
- buy, sell, exchange or let places of residence, business or land, or interests in them
- collect rent
- buy, sell or exchange livestock or interests in them
- negotiate to buy, sell, exchange or let residences, businesses, land or livestock
- transact or negotiate the sale or rent of property
- show property
- appraise or inspect property for sale or rent
- advertise, place signs or conduct open inspections on properties for sale or rent.
If a corporation performs any of these real estate activities, it must hold a real estate agent corporation licence. At least one director must hold a real estate agent licence. In addition, any other directors who perform real estate activities in the business must hold a real estate agent licence.
A corporate licensee may operate at more than one office if an appropriately licensed person is in charge at each office at all times.
An individual licensee must be in charge of the principal place of business. A licensee who operates at more than one office must have an appropriately licensed person in charge at each office at all times.
Independent contractors
If your real estate agency employs you on a contract basis, you probably need a full licence. Seek independent legal advice.
If your real estate agency employs you directly, you could hold either a:
- full real estate agent's licence
- real estate salesperson certificate of registration, if you do not carry out duties that require a full licence.
If you are a subcontractor to an independent contractor, seek independent legal advice regarding the licence type you need. Subcontractor arrangements are handled case by case.
For pastoral house agents
You must get a pastoral house agent licence if you do any of these activities for financial reward:
- hire licensed pastoral house managers and auctioneers
- sell rural land (land that is zoned as rural) and livestock
- auction rural land, livestock and wool
- auction plants, machinery, furniture and other items situated on rural land (chattels)
- auction non-rural land as long as there are four or less auctions a year for each pastoral house business location
- operate a trust account (pastoral directors only)
If a corporation performs any of these activities, it must hold a pastoral house agent corporation licence, and at least one director must hold a pastoral house agent licence.
