
Appoint a substitute licensee |
For all property agents
You can appoint a substitute licensee to run your business while you are away for illness or holidays. We recommend that the substitute hold the same licence as you. However if this is not possible, you can appoint a suitable adult to run the business while you are away.
When you appoint a substitute, you accept responsibility for ensuring that the substitute has the skills to carry out the tasks. You are also responsible for any breaches they make while you are away.
Fewer than 30 days
If you are away from your business for up to 30 days, you can appoint a substitute licensee to run your business. You do not need to notify us. However, the substitute licensee must give written and signed consent to be your substitute. Therefore, you should make the appointment in writing, ensuring both you and the appointed substitute sign it. If you need insurance as a condition of your licence, your substitute must also have the same level of insurance.
The substitute licensee must be an adult and be suitable to hold a licence. A suitable person is defined as some who has not been:
- affected by bankruptcy action
- convicted of a serious offence in the previous five years
- disqualified from holding a licence or registration certificate
- recorded in the register of disqualified company directors under the Corporations Act 2001.
You can appoint a substitute licensee only for up to 12 weeks in any 12 month period.
More than 30 days
If you are away from your business for more than 30 days, you need to apply for a substitute licensee. The substitute license must give written and signed consent to be your substitute. You are also required to notify us by completing the approved form and seek approval to appoint a substitute licensee whilst you are away. If you need insurance as a condition of your licence, your substitute must also have the same level of insurance.
To apply:
- complete PAMD Form 11 - Application for appointment/extension of appointment of substitute licensee (PDF, 506 KB)
- pay the application fee of $69.00
- provide certified proof of identity for the substitute
- pay a criminal history check fee of $38.40 for the substitute (if a check has not been done in the previous six months)
- lodge the application (see the form for lodgement details).
We can approve substitute licensees only for up to 26 weeks in any 12 month period.
The substitute licensee must be an adult and be suitable to hold a licence. A suitable person is defined as some who has not been:
- affected by bankruptcy action

- recorded in the register of disqualified company directors under the Corporations Act.
Processing time
Processing time is 4-6 weeks from lodgement. However, it can take longer if we need to contact you for missing information or fees.
