Cancelling your licence
If you hold a current licence and are convicted of a disqualifying offence, we will automatically cancel your licence. You cannot appeal the cancellation, and you will be penalised if you work unlicensed. You will be ineligible for a licence for ten years from your conviction date.
If you are found guilty of a disqualifying offence, but conviction is not recorded, you may be asked to justify why your licence should not be cancelled.
Disqualifying offences
A disqualifying offence is any offence you have been found guilty of:
- under the Weapons Act 1990 that is punishable by one year’s imprisonment or more. Examples include possessing certain firearms without a licence, dangerous conduct with weapons and failure to adequately store weapons
- under the Drugs Misuse Act 1986 that is punishable by one year’s imprisonment or more. Examples include possessing, producing or supplying dangerous drugs, and possessing items used with a dangerous drug
- under the Police Service Administration Act 1990, sections 10.19 (b), (c), (d), (e) or (f). One example is impersonating a police officer
- against a Criminal Code provision that is mentioned in the Schedule to the Act. Examples include murder, manslaughter, rape, assault, sexual assault, indecent assault, stealing, false pretences, fraud, theft, armed robbery, receiving stolen property and dangerous driving.
