Fair Work Ombudsman campaigns and audits

During August and September 2009, the Fair Work Ombudsman has advised the Office of Fair Trading that it will be distributing information nationally to educate security industry employers about their rights and obligations under Commonwealth workplace laws.

Following this education campaign, the Fair Work Ombudsman will target a number of security industry employers to conduct audits under the Fair Work Act 2009 and the Fair Work Regulations 2009, to ensure compliance with the law.

During the audits, Fair Work inspectors will work with security industry employers to ensure any identified issues are resolved voluntarily. However, if serious or wilful contraventions of Commonwealth workplace laws are identified, enforcement action will be commenced by the Fair Work Ombudsman.

Breaches of Commonwealth workplace laws by a security industry employers or employees may effect a licence status of both entities under the Security Providers Act 1993, administered by the Office of Fair Trading. While the onus is on the individual security provider to ensure they have the appropriate licence, it is also important that employers check to make sure the people they are hiring are correctly licensed.
