Government response to the report on the review of regulatory reform (phase 2) – Property Agents and Motor Dealers Act 2000
The former Service Delivery and Performance Commission (SPDC) conducted a review to identify the major regulatory features of the Property Agents and Motor Dealers Act 2000 (the Act) and its associated Regulation and Codes of Conduct. The review also recommended changes to reduce red tape for business while maintaining effective consumer benefits.
The government has considered the review report and has provided its response outlining those recommendations it will implement. Both the SDPC review report and the Government’s response have been listed in one document and are available to download.
The recommendations accepted by the government are to be implemented in three packages by the Department of Employment, Economic Development and Innovation (DEEDI):
- Amendments to the Act for immediate implementation are mainly minor, or technical in nature, and are being progressed. These reforms include removal of a number of existing requirements including:
- the supply of photo identification for licensing
- proof of Local Authority approval for motor dealer premises
- employment authorities for registered employees
- simplifying the requirements for providing notices with warning statements and residential property contracts.
- Redesign of some of the approved forms under the Act will progress separately. Particular focus will be on PAMD Form 30C and all motor dealing approved forms. Work will also commence immediately on the redesign process.
- Major amendments, including separation of the Act into separate industry specific Acts and reform of the Codes of Conduct, will be conducted in conjunction with the implementation of a National Licensing System for property agents. This is being conducted through the Council of Australian Governments. It makes sense to combine these major reforms to minimise the impact on stakeholders.
The implementation of the accepted reforms to the Act will provide real benefit to business as it will reduce red tape and the regulatory burden on industry. It will also provide separate, specific legislation for each industry currently regulated, without forfeiting any consumer protection offered by the legislation.
