Statutory warranty on used car purchases

Peter recently purchased a second-hand car from his local dealership. It was approximately eight years old and had 140 000 km on the clock. After only six weeks the car broke down.

Peter managed to get his car home and then immediately called the dealership to explain the problem.

Does the dealership have to fix Peter´s car?

Yes. The car is still under what is known as a mandatory statutory warranty. This type of warranty applies to second-hand vehicles purchased from licensed dealers. In Peter´s case, he is covered for three months or up to 5,000 km.

The dealership gave Peter instructions to deliver the car to their chosen repairer. For each day that the repairer had Peter´s car, an extra day was added on to his statutory warranty.
