Client care statement
The funeral provider must complete a Funeral Benefit Business Act Form 1 - Client care statement (PDF, 251 KB) and give you a copy before you sign a contract with them.
They must write the statement in plain English, and state their and your rights and responsibilities.
The statement should clearly outline:
- the services they provide
- fees and charges you will pay
- the cooling-off period.
All new prepaid funeral contracts have a 30-day cooling-off period.
If you cancel in this time, the provider must refund the full amount, minus a $50 cancellation fee, within seven days of receiving your notice.
If the provider fails to provide, explain or retrieve a signed client care statement, they can be fined up to $14 700 for individuals and $73 700 for companies. Similar fines apply if they fail to comply with the cooling-off period.
