Issue:
Denmac Ford Pty Ltd placed into receivership.
Response:
The Office of Fair Trading (OFT) is aware that Deloitte have been appointed as the receivers and managers over the west Brisbane car dealership Denmac Ford Pty Ltd.
The role of the receiver is to investigate the company´s affairs, to report to creditors and to recommend to creditors if the company should enter into a deed of company arrangement, go into liquidation or be returned to the directors.
OFT does not have the legislative power to obtain money back for consumers when a company is in receivership. If a business closes down, becomes insolvent, or goes bankrupt, and you have paid for a product or service in part or full and have not received it you become an unsecured creditor of the business. In such situation you should be contacted by the receiver to explain the administration process. Deloitte can be contacted by phoning 07 3308 7000.
Read Deloitte´s media statement.
If you have any queries or complaints with the receiver and the receiver fails to resolve your concerns, the Australian Securities and Investment Commission (ASIC) is the appropriate agency to lodge a complaint. ASIC can be contacted at www.asic.gov.au or phone 1300 300 630.
At this stage the OFT has not received any formal complaints from consumers who have paid deposits or paid in full for goods which have not been delivered.
Consumers who believe a business they've dealt with has acted illegally can lodge a complaint online or by phoning 13 QGOV (13 74 68).
