The national harmonisation of debt collection regulation is a Ministerial Council on Consumer Affairs (MCCA) project to streamline debt collection regulation throughout Australia. It is being advanced through the Standing Committee of Officials of Consumer Affairs (SCOCA) strategic agenda in the context of the COAG seamless national economy project.
SCOCA has released a discussion paper on proposed options for harmonising debt collection regulation throughout Australia for public comment.
Debt collection in Australia is currently regulated by complex and overlapping legislation, which has caused problems and costs for both consumers and industry.
The discussion paper outlines a range of options which could be adopted to harmonise the regulatory framework amongst the Commonwealth, States and Territories. These options consider:
- licensing
- conduct
- trust accounts
- complaints handling
- administration
- information standards
- education requirements.
The discussion paper also explores the suitability of using the National Occupational Licensing System (NOLS) and the National Credit Model for regulating the debt collection industry.
