Criminal and Other Legislation Amendment Bill 2011

The Criminal and Other Legislation Amendment Bill 2011 sought to introduce a number of amendments to fair trading legislation to improve the clarity and operation of the legislation.

The Bill was introduced into Parliament on 13 October 2011. The Criminal and Other Legislation Amendment Bill 2011, Explanatory Note and Explanatory Speech can be found on the Office of the Queensland Parliamentary Counsel website.

The Criminal and Other Legislation Bill 2011 lapsed on 19 February 2012 with the dissolution of Parliament prior to the 2012 Queensland General Election.

Security Providers Act 1993

The Security Providers Act 1993 includes a requirement for licensed security firms to be members of an approved security industry association. The Bill allows the chief executive to impose conditions on the approval of a security industry association.

The Bill also provides aggrieved associations with an ability to apply to the Queensland Civil and Administrative Tribunal for review of various decisions of the chief executive. It also clarifies the obligation of a security industry association to notify the chief executive when a security firm ceases to be a member of the association.

Land Sales Act 1984

The Bill amends the Land Sales Act 1984 to remove the current requirement for developers selling off-the-plan lots of residential units to apply for an extension of time for giving a registrable transfer, and for this extension to be prescribed in the Regulation.

The benefits to consumers provided by this process are outweighed by the associated administrative burden involved for both developers and government. Instead, vendors will be able to specify the time for giving the registrable transfer in the written contract, up to a maximum of five and a half years. Otherwise, if not specified, a default period of three and a half years will apply.

The Bill amends the Retirement Villages Act 1999 to clarify a number of operational issues including:

Collections Act 1966

The Bill amends the Collections Act 1966 to streamline the appointment of fair trading inspectors to investigate complaints and to allow the chief executive, rather than the Governor-in-Council, to appoint members to the Disaster Appeals Trust Fund Committee.

Credit (Commonwealth Powers) Act 2010

The Bill amends the Credit (Commonwealth Powers) Act 2010 to allow online publication of conduct deeds.

Roman Catholic Church Lands Act 1985

The Bill amends the Roman Catholic Church Lands Act 1985 to correct an omission in the schedule of land interests vested in trustees for the Roman Catholic Church.
