Note: If you apply for a corporate auctioneer licence, you must also have an individual auctioneer licence.
This licence allows your company to:
- sell or attempt to sell, or offer for sale or resale, any property by way of auction
- sell by any means during the auction period.
Note: You do not need a licence to run a charity auction.
Restrictions
Under the licence:
- at least one licensed director must stand for the auctioneer corporation who carries out any of the activities listed above. However, if all directors are active in the business, they each must apply for an individual auctioneer licence
- a fully licensed person must be in charge at every office
- the company must have a principal place of business in Queensland
- the company must have employment register.
Eligibility
A corporation is suitable to hold a corporate auctioneer licence if:
- a director of the corporation is a licensed auctioneer
- local government authorises your premises as suitable for carrying out your business.
A corporation is not suitable to hold a corporate auctioneer licence if:
- it has been placed in receivership or liquidation
- an executive officer or director has been affected by bankruptcy action
- an executive officer or director has been convicted of a serious offence anywhere within the last five years, including any of the following criminal activities punishable by three or more years of jail:
- fraud and dishonesty
- drug trafficking
- extortion
- arson
- unlawful stalking
- violence or the threat of using violence
- any offence of a sexual nature
- an executive officer or director has been disqualified from holding a licence or registration certificate
- an executive officer/or director has had a cancelled or suspended property agent licence or registration certificate
- an executive officer or director has caused a pay out from the property agents and motor dealers claim fund
- an executive officer or director has been disqualified from being a licensee or executive officer of a corporation
- an executive officer or director has been listed on the national register of disqualified company directors
- an executive officer or director has had an order made against them by the Property Agents and Motor Dealers Tribunal
- we decide that the company is not suitable to hold a licence.
Training requirements
There are no training requirements for a corporate licence, as you will have completed training as part of your individual licence.
Applying for a corporate auctioneer licence
To apply:
- meet the eligibility criteria
- complete PAMD Form 1-2 and notes - Application for corporate licence (PDF, 588 KB)
- provide originals or certified copies of your birth certificate, birth extract, passport, Australian citizenship certificate or drivers licence (see below for advice on getting certified copies)
- provide certified, passport-quality photos of yourself
- pay the licence fee of $605 for one year or $1085 for three years
- pay the criminal history check fee of $35.50 of each executive officer/director and business partner/associate
- lodge the application (see the application form for lodgement details).
Criminal history checks
Applicants must undergo a criminal history check to confirm their suitability.
The criminal history check costs $35.50 (which includes $1.13 GST) for each person who appears on the application form. The fee applies to all applications and renewal notices.
Processing time
Processing time is 4-6 weeks. However, it can take longer if we need to contact you for missing information or fees.
The processing time may be up to six weeks because the criminal history check process, handled by Queensland Police, is thorough and time consuming.
Making the process quicker
Send certified documents
Take the original document and a copy to a Justice of the Peace, Commissioner for Declarations, solicitor, barrister or a Notary Public. They will stamp and/or sign the copy and write ‘This is a true copy of the original document’.
The Department of Justice and Attorney-General has a list of JPs in your area. Otherwise, contact your local post office, courthouse, bank, shopping centre manager or pharmacy.
We will send your original documents to you after we assess your application. Please note that a photocopy is not a certified document.
Pay all criminal history check fees
Remember to pay a separate fee for yourself and each person on the application form.
Refunds for unsuccessful applications
If your application is unsuccessful or it is withdrawn, you will receive a partial refund. Your application fee is non-refundable, but we will refund your licence fee and any unused criminal history check fees.
